The rollout is gradual, not immediate
No specific form became electronic-only merely because the framework took effect. The rule authorizes USCIS to designate an eligible benefit request for mandatory electronic filing in the future, one form at a time.
Until USCIS announces an effective date for a specific form, employers and their immigration teams should follow the instructions currently published for that form. A general announcement does not end an otherwise valid paper process.
How a form becomes online-only
The request must first have been available for online filing for at least 180 days. USCIS must then provide at least 60 days of advance notice before that particular form becomes electronic-only.
The rule also creates a waiver process for filers who cannot reasonably comply with an electronic-filing requirement. Employer immigration teams should look for a notice that names the specific form and gives its effective date.
The eligibility rules stay the same
The framework changes the submission channel. It does not by itself change a visa category’s qualifications, evidence standard, filing deadline, or the facts the employer and sponsored employee must establish.
When a form does move online, the familiar completion checks still matter: payment, signature, evidence upload, submission confirmation, and receipt capture.
Preparing an employer immigration workflow
Confirm who owns each USCIS account, who can sign, how evidence is named, and how receipts return to the case record. Rehearsing one representative online filing can reveal access or file-size issues before a real deadline.
Keep the existing lawful paper workflow available until the applicable notice says otherwise, and assign an owner to monitor official USCIS form pages and alerts for the filing types the company actually uses.
What to do now
- The framework did not make every USCIS form electronic-only immediately.
- USCIS must give advance notice for each form it designates.
- Electronic filing changes the channel, not the underlying qualifications for a benefit.
- Preserve the current lawful filing method until the applicable form notice says otherwise.
